Our industry has been supporting a framework for a federal privacy law for several years and though both parties in Congress support such an aim, passage of a law has been elusive. Next month, our industry—through 4A's, ANA, BBB National Programs, TAG and DAA—will have its first-billed "Advertising Day on the Hill," a chance to meet face-to-face with Republican and Democrat Members of Congress and their staffs to help advance a federal privacy regimen that is perhaps practical and pragmatic—and preemptive. Industry participants weigh in on what we can expect.

I Motion to Dismiss! Private rights of action have flooded courts, and many advertising organizations, with creative attempts to re-interpret, in some cases, age-old laws in various class-action theories. Even some state enforcers are sympathetic in their own pursuits of "justice"? Is a pixel really a wiretap? What can marketers do to manage these risks and be ready when a legal notice arrives.
